These Terms of Use are provided by Proud Co.i (hereinafter referred to as "Team," "we," "our," or "us").
By registering an account, accepting the in-game user terms and privacy policy, or otherwise accessing or using the service, you agree that you have read, understood, and agreed to be bound by this End User License Agreement (EULA) and our privacy policy. If you do not agree to the EULA or our privacy policy, you should not use this service.
We may change the EULA and our privacy policy at any time without prior notice, and such changes will be effective upon posting. Your continued use of this game will be considered your acceptance of the revised EULA. If you do not agree to these EULA, please do not use this game.
Note: This game and the services it provides do not involve "real money gambling." Playing the game does not require actual currency, and this service is for entertainment purposes only. You cannot obtain any real money from casual gaming.
You declare and warrant that you have the right, power, and ability to accept these terms and comply with them, you have reached the legal age, and you have fully read and understood these terms. Before checking the acceptance box, you must carefully read all the content of these terms. By checking the acceptance box or by accessing the game or creating a user account, you confirm that you have read and agreed to be bound by these terms.
1. Limited Revocable License
a. Virtual Currency. The service may include virtual in-game tokens ("Virtual Currency"), including but not limited to chips, coins, points, or purchased money. Currently, diamonds are used in the game. Diamonds can only be obtained by watching advertisements. Subject to your agreement to and ongoing compliance with these terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sub licensable, revocable license solely for your personal, private, entertainment use and for no other purpose. Except for the limited, personal, revocable, non-transferable, non-disclosable license to use virtual currency on the service, you have no right to use any virtual currency obtained from or derived from the service or any rights or ownership related to the use of the service or stored in the service. You acknowledge and agree that your use of the service is subject to these terms, and if you do not agree to these terms or violate them, your license to use the service may be terminated immediately. We have the right, within the limits allowed by law, to fully manage, regulate, control, modify, and/or eliminate these virtual currencies, and we are not responsible for the exercise of these rights on you or others.
2. Transferring or selling virtual tokens to anyone else is strictly prohibited. You are also prohibited from selling or transferring your user account to anyone under any circumstances. Any attempt to do so is a violation of these terms and may result in the closure and confiscation of your user account, as well as a possible lifetime ban from the service and potential legal action.
3. Casual games do not earn any real money. These terms do not grant you any rights, ownership, or interests in the service.
4. The service is licensed to you, not sold. You agree that we and our licensors own all ownership, rights, and interests in the service, including all intellectual property rights, even after installation on your device, we still retain ownership of the service. You agree not to remove or alter any copyright, trademark, or other proprietary notices or marks that may appear on the service in any way.
5. Unless expressly stated in these terms, you agree not to:
a. Sell, rent, distribute, transfer, license, sublicense, lend, or otherwise transfer any rights to any part of the service to any third party.
b. Copy, modify, create derivative works of this service (including but not limited to any software constituting part of this service), including but not limited to adjusting or modifying this service.
c. Copy the service or any part of it in any form or manner.
d. Use the service in any unauthorized way, including but not limited to intrusion or increased network capacity.
e. Unlock, decompile, reverse engineer the entire or part of the service, or attempt to derive the source code of the service, or allow or authorize a third party to do so, unless such activities are expressly permitted by law.
f. Provide the service to multiple users in any way, including uploading the service to file-sharing services or other types of hosting services, or providing the service in a way that allows it to be used by multiple devices simultaneously.
g. Misrepresent the ownership source of the service.
h. Capture, database, or otherwise create a permanent copy of any content of the service; or in any way use the service to harass, abuse, track, threaten, defame, or otherwise violate the rights of any other party.
2. Eligibility
1. You are at least 18 years old or the minimum age required by law in your jurisdiction, whichever is higher, and under the laws of your jurisdiction, you are allowed to participate in and access the service in the game.
2. You understand and accept that we cannot provide you with any legal advice or guarantees, and you are responsible for ensuring that you always comply with the laws applicable to you and that you have full legal rights to use the service.
3. You will monitor your user account and ensure that no children under the age of 18 use your user account to access the service. For unauthorized use of the service by minors, you will be solely responsible, and you acknowledge your responsibility for minors using the service, including minors using your credit card or other payment tools.
4. You do not reside in and will not access the game or service from the states of Washington, Idaho, or Nevada in the United States, and the province of Quebec in Canada.
5. Your participation in the game is limited to personal and casual entertainment purposes.
6. During the term of these terms, all information you provide to us will be true, complete, and accurate.
7. In any game, you will not engage in any fraudulent or other illegal activities when participating in any game, and you will not use any software-assisted methods or techniques (including but not limited to "bots" designed for automatic play) to participate in any game. We reserve the right to declare invalid any participation at our sole discretion if such behavior occurs.
3. User Account
1. You acknowledge that you will not share your user account or password with others or allow others to access or use your user account without our written permission. You will not access or use user accounts that have been rented, leased, sold, traded, or otherwise transferred from the account creator without our written permission.
2. If you discover or have reason to believe that the security of your user account may be compromised, including the loss, theft, or unauthorized disclosure of passwords and user account details, you must notify us immediately.
3. You are responsible for maintaining the confidentiality of your user account and for all use of your user account.
4. If your user account is inactive for 60 days, we reserve the right to close your user account. The party agrees that the party may not be notified before taking such action, although the party may choose to do so at its sole discretion.
5. If you wish to close your user account, you can contact customer support at any time. Closing your user account will waive your rights to continue using, enjoying, or benefiting from any virtual currency associated with your user account.
6. We reserve the right to refuse or close user accounts at our sole discretion.
7. You can close your user account at any time by contacting customer support.
4. Verification
1. You acknowledge that we have the right to conduct any checks (including but not limited to credit background checks) that we may reasonably request and/or checks required by applicable laws, regulations, or relevant regulatory authorities. You agree to comply with all verification checks immediately.
2. The party agrees that we may limit the party from opening or using a user account until the party has completed satisfactory verification checks for the party.
3. The requested documents may include identity documents (including photo identity documents) such as passports or driver's licenses issued by government identity documents; utility bills matching the address in your user account profile; and documents related to the source or origin of wealth, such as pay stubs or bank statements.
4. If you fail to provide any documents in the form requested by us by the date requested by us, resulting in any verification check being unable to be completed, we may, at our sole discretion, deactivate or restrict your user account.
5. You acknowledge and agree that we may use third-party service providers to conduct external identity verification, location verification, and other verification checks based on information provided by you from time to time. You must enable and allow "location services" on your device or computer to operate the service or access your user account.
5. Intellectual Property
1. These terms grant only the right to use the service and do not transfer any ownership of the service.
2. All rights, ownership, and interests, including but not limited to any copyrights, patents, trade secrets, or other intellectual property rights, will become our sole property, or if obtained from third-party licensors, their sole property.
3. Your use of the game will not transfer to you any intellectual property. The use of the game titles, source code and object code, game client and server software, the "look and feel" of the game, sounds, music works, visual effects, concepts and operation methods, layouts, text, data, user accounts, themes, objects, characters and their portraits, names and profile information, stories, dialogues, catchphrases, locations, artworks, animation files, images, graphics, files, game history and game records, records of any chat rooms, and moral rights related to the above, whether registered or not, and all applications related to the above, are owned by us or any third-party providers of the game.
4. Unless otherwise specified in these terms, you acknowledge and agree that you have no ownership or other property rights in the user account, and you further acknowledge and agree that ownership of the user account will always belong to us and will be used for our use.
6. Liability
1. You are responsible for complying with all laws regarding your user content. You agree not to submit or send any material to the service that is defamatory, inaccurate, abusive, obscene, profane, threatening, harassing, racially discriminatory, or illegal.
2. You will not provide us or other users of the service with inaccurate, misleading, or false information. If the information provided to us or other users of the service becomes inaccurate, misleading, or false, you will promptly notify us of these changes.
3. We may, at our sole discretion and without notice, delete any user content, but we are not obligated to do so. We are not responsible for the behavior of any user on the service, including any user content submitted on the service. We are not responsible for monitoring inappropriate content or behavior on the service. Your use of the service is at your own risk.
4. You hereby grant us a unique, irrevocable, transferable, global, free license to copy, modify, create derivative works, publish, distribute, sell, transfer, transmit, publicly display, and use any user content in any form, media, or technology now or hereafter developed.
5. You further grant us an unconditional right to use and exploit your name, likeness, and other information in any user content or materials related to your user account without any obligation to you. You waive any attribution rights and/or any moral rights you may have in your user content, whether modified or changed in any way, unless prohibited by law.
6. You acknowledge and agree that all user content, whether publicly posted or privately transmitted to the service, is your personal responsibility
and risk. We are not responsible for backing up and/or retaining any user content transmitted to the service.
7. Content prohibited on the service; user content prohibited on the service includes, but is not limited to:
a. User content that promotes racism, hatred, or any form of physical harm to any group or individual.
b. Harassing user content.
c. Sexual or offensive user content.
d. User content that promotes terrorism or religious hatred.
e. User content that promotes illegal activities or has an abusive, threatening, obscene, or defamatory nature.
f. Commercial user content without our authorization; or user content that promotes other businesses or competitive services.
7. Indemnification and Liability Limitation
1. To the extent permitted by applicable law, we and our subsidiaries, affiliated companies, executives, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury or property damage, data loss, loss of use, expected savings loss, wasted expenses, cost of purchasing alternative goods or services, loss of reputation, or other intangible losses, resulting from:
a. Your access to or use of, or inability to access or use the service.
b. Any third-party acts or content on the service, including but not limited to any content provided by advertisers, affiliate advertising networks, reward program operators we may cooperate with, or payment providers for the service or any other users, products, or services on the service.
c. Any content and/or information obtained from the service or reliance on any part of the service.
d. Unauthorized access or use or alteration of any materials or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether we knew or should have known of the possibility of such damages.
2. In some jurisdictions, applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. The limitation of liability mentioned above shall apply to the maximum extent permitted by the applicable jurisdictional law. None of the provisions in these terms shall exclude or limit consumer rights based on mandatory provisions in these terms. To the maximum extent permitted by applicable law, our total liability and/or our subsidiaries' total liability and/or our affiliated companies' liability arising from or in connection with your use of the service is limited to the total amount.
3. In no event shall we be liable for any viruses, errors, human acts or negligence, any computer system, telephone line, hardware, software, or program failure, or any other errors, failures, or computer transmissions or network connections resulting in delays or damage.
4. In any case, we are not responsible for any damages, claims, liabilities, or expenses incurred by you due to any third-party content, products, or services provided or promoted on the service.
5. You waive and release us and our subsidiaries, affiliated companies, partners, executives, directors, employees, and agents from any liability arising from or related to any actions or misconduct of any third party.
6. You agree to indemnify and hold us harmless from any claims or demands arising from your use or access to the service, violation of these terms, or violation of any law or third-party rights, including any claims or demands made by third parties as a result of your actions or omissions.
8. Miscellaneous
1. Entire Agreement. These terms constitute the entire agreement between you and us regarding your use of the service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us regarding your participation in activities.
2. Taxes. You will be responsible for any taxes incurred as a result of using the service.
3. Force Majeure. We will not be responsible for any failure or delay in fulfilling any obligations under these terms due to events beyond our reasonable control.
4. Severability. If for any reason any provision of these terms, or any part thereof, is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision or part shall be deemed severable, and shall not affect the validity and enforceability of the remaining provisions or parts thereof, which shall remain in full force and effect.
5. Assignment. These terms are personal and may not be assigned, transferred, or assigned by you without our prior written consent. We reserve the right to transfer, assign, or delegate our rights and obligations to any third party without notifying you.
